Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Hey Again LLC (“HeyAgain,” “we,” “us”). By creating an account or using heyagain.ai, you agree to these Terms. If you are using the service on behalf of a business, you represent that you have authority to bind that business.

HeyAgain is an AI-powered SMS lead reactivation SaaS platform. We provide software that sends and manages SMS conversations with your business contacts on your behalf, using AI to re-engage leads and route interested responses back to you.

HeyAgain is offered on the following monthly subscription plans:

• Growth — $297/month, up to 500 leads/month
• Scale — $597/month, up to 2,000 leads/month
• Agency — $1,497/month, up to 10,000 leads/month

• All subscriptions are billed monthly via Stripe.
• No refunds are issued for partial months.
• Leads processed above your plan limit are billed at $0.05 per lead.
• You may cancel at any time; cancellation takes effect at the end of the current billing period.

You agree that you will not use the service to:

• Send spam or unsolicited messages of any kind.
• Send SHAFT content (sex, hate, alcohol, firearms, or tobacco related messaging) or any content prohibited by carrier rules.
• Message contacts you do not have a prior business relationship with.

You must comply with the Telephone Consumer Protection Act (TCPA) and all other applicable laws and regulations when messaging contacts through the platform. We may suspend accounts that violate this section.

You are solely responsible for obtaining and maintaining any consent required to contact the individuals on your lists. HeyAgain provides the messaging platform only — we do not verify, and cannot verify, that your contacts have consented to be messaged. You agree to indemnify HeyAgain against claims arising from your failure to obtain required consent.

We may suspend or terminate your account if you breach these Terms, fail to pay fees when due, or use the service in a way that creates legal or carrier risk for HeyAgain. You may terminate your account at any time by contacting us. Upon termination, your right to use the service ends immediately.

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Hey Again LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Utah.
